RESUMO
O objetivo deste artigo é apontar que a psicanálise tem a função social de questionar doutrinas que condenam a infanto-juventude ao tratamento penal. Para isso, faz-se uma revisão bibliográfica através da psicanálise para analisar o adolescente que se envolve com o tráfico de drogas. Verifica-se que o conceito de infância passou por profundas modificações, de modo que o ser infantil diferenciou-se do ser adulto apenas nos últimos séculos da humanidade; que as identificações feitas pela criança com as figuras de autoridade são vitais e possuem aproveitamento variados para o sujeito; que o processo de separação do Outro é, por inerência, uma transgressão, e que essa transgressão pode ou não ocorrer dentro da lei jurídica(AU)
The purpose of this article is to point that psychoanalysis has the social function to question the doctrines that condemn children and youth to the penal treatment. For this, a literature review is made through psychoanalysis to analyze the relationship of the adolescent that engages himself in drug trafficking. It appears that the concept of childhood has undergone profound changes in social levels, so that the child be differed from being grown only in the last centuries of humanity; the identifications made by the child with authority figures are vital and possess qualities and varied roles for the subject; the separation process from the Other is inherently a violation, and that transgression may or may not occur at the level of legal law(AU)
